Take the matter to Court

Don't have a good opinion about Janak Puri Police Station
On June the 6th when the Constable had come, I had told him that the Police should take the matter to Court. Now he is only a Constable I know but then he is a Police wallah. He asked me to take it to Court if I so wished and that the Police can't do that. I then told him that I don't know how this has to be taken to Court. He said that the local PS will tell me how that is done. Now I might take this to Court not because this duty bound person said so but just because I have made up my mind anyway.

And by the way, I don't have a very good opinion about this Janak Puri Police Station. They have heavy egos and forever trying to play a game of one upmanship. And they don't know how to talk. They don't understand protocol. They don't know how to talk to an educated professional and how to conduct in his presence. Details on that may appear elsewhere. (I wish I was doing something else.)


The following is not related with this episode, but these and more are the reasons that I mentioned that I don't have a good opinion about this PS.


In 2007, my two wheeler had been wrongly detained by these people and I thought that it got stolen. I still don't know who the miscreants are who managed to take it to the PS. I came to know after some time that it is with the local PS. There was this Kalam Singh who spoke shit, and he escaped any internal enquiry and action. I don't know where he is. But I will be looking for him some time. This world is round. Details on that may (or may not) come somewhere on my internet platforms.


2011-12: Smell case like this present one - they were just passing time. I mean there was hardly any intent to solve our problem. Only at the fag end of several weeks the SI said that they can send the matter to Court - "phir aap jaano aur yeh jaanein".


In 2014 some Puris from Hari Nagar threatened me with bombs. They made me work on some website of theirs which I did out of courtesy, and then they started to pile on me bad, real bad. They started to levy false accusations and used foul, abusive language and that they would get me picked. The Police was informed. The Police did not do anything. Their Head Constable on the contrary started to levy false allegations on me and started to toe the line of these criminal Puris. Satish Puri and his wife Shital Puri, by the way, might themselves get picked up some time, if they have not been picked up already. I am not following this case or episode as yet.


In 2015 there was this problem of smell from my next door neighbour who had begun to stock chemically dowsed artificially made agarbattis on his terrace and the stench was unbearable. His already running terrace business is illegal by MCD's own rules itself by the way. The entry to this Office is from the staircase which is meant for residents, not for his illegal UP Bihar louts. His Office boys are badtameez, rude and some are prone to indulging in violence. Police was informed. The Police did not make contact at all. No Contact At All.


So therefore, to expect the Janak Puri PS to live up to 'With You For You Always' is a very very tall order indeed. You can forget it. They have super bloated egos and they are responsibility shirkers. The only thing they know is that rather than the predicament of the citizen that they are supposed to solve, there is a game of oneupmanship which they must always win!

Close proximity of crime dens to residential quarters

Smell arrives in waves, then it stays, then the next wave arrives.
6th June: Smell intensity increased. It comes in waves. Then it stays. Then the next wave comes. It may or may not have to do with the wind. It's the sheer proximity of these illegal crime dens to our simple homes.

There has been no response from the Janak Puri Police Station. Smell is there, burnt particles can be felt. In the evening at 9:16 PM (June 6, 2016) , I called 100 (PCR - Police Control Room Delhi Police) again. I told them that I had called earlier on 29th May and that the problem is still there. The person on the other side responded that they'll send Police. I said that he should know what the issue is about. But he had hung up. I thought that at least the Police will come now.
I got a call at 9:42 PM from 9821003250. The person said that I had called 100 and that they are here. I then went down and met the person. I told him what the issue was about. He had actually rung another house bell because of some lack of understanding on his part about 'second floor'. Anyway, that's trivia. So when he came to know about the issue, he said one should call 100 in case of fights, arson etc. I told him that I know this and I dialled 100 because this problem that we are facing is really disturbing our peace and it is damaging our health. I took him to the place from where the smell was emanating. He was actually hesitant. He said what will he do there. I had to mildly persuade him to come along. (Perhaps the rear lane in the night might appear a little shady.) So he came along and then I showed him the place from where the smell was emanating. And strangely, at that time, the smell was very less in comparison! So he said, 'where is the smell?' I told him that 'yes at this moment it is very little but it is there'. Then he asked how can the smell travel to our house. I told him that it does. It's not very far. Then I took him back along that route from where we had come. We walked about 15 metres along that rear lane and then I showed him my house, about 12 metres away (in a horizontal line). He said that the local Police Station will take care of this. I told him about the Complaint submitted a day earlier. He said that this call would also have gone to the local PS.

The length of a horizontal line (or the distance horizontally) that starts from this flat and reach our flat unobstructed is less than 35 metres. And plus (I have mentioned in the Plaint also) the horizontal distance in a straight line (as the bird flies) from this Flat to our Flat is less than 30 metres.

I asked him to take a look at the front of this Restaurant also. He was reluctant. He said again that the local Police Station will look into this. I told him again that the local PS has been told. There was also a little talk from my side with an elderly citizen of the Block who had just stopped by, and I told him that in the coming months the problem will only increase since in winters the wind blows from the North East in Delhi and these Restaurants are in the NE direction from our house. The Police person was privy to this small talk. Hope the Delhi Police understand the gravity and doesn't wait for winter, btw.

Then the policeman started to look for his Police Car in which he had apparently come. The Car had already gone out of the Block. I asked him his name. He said he was Constable Kailash. I accompanied him till the Gate of the Block and then asked him again that he can see Wah Ji Wah from the front side. Then he left and I came back. I don't know if he went there, I don't know if there were actually more people in the Car who went there earlier. It did not occur to me at that time that perhaps I should have persuaded the Constable to go to the front side and show him the joint. Perhaps that is immaterial.

In DDA Flats, Fire is burnt. There is Tandoor, Coal is Stored and Burnt, Commercial Kitchens Run.

Fire is burnt in DDA Flats. There is tandoor in DDA Flats. Coal is stored and burnt in DDA Flats. Commercial Kitchens run from DDA Flats.

In fact on 4th June in the evening, I went up the 85-86 Flats' Staircase to go to the terrace and figure if they have got a duct or chimney from within the shaft as the Restaurants Soya Expresss and Zaika had done in 2011-12 (and that is completely illegal). The entry to the Terraces were locked. In fact 85D (which was earlier a terrace above 85C) has a built up structure now. Then I tried to recall whether indeed from the main road it is apparent that this is built up now. (Actually the entire identity is gone, it's getting messed up, chaotic - you can't make out which flat is which.) This 85C terrace actually had some signs at the entrance. It says that they are opening up a saloon there. The following no. was mentioned - 9711749506. I called up this no. at 8:04 PM. I asked the person whether he owns the Flat at Flat 85C, Block C2B of Janak Puri. He took his time in understanding the address and the flat. In fact I had to remind him about the saloon. I thought that was strange. Anyway, I told the person that I am just outside of their Flat and just wanted to take a look at the shaft and make sure that the Restaurant owners at Wah Ji Wah on the ground floor at 85A are not expelling fumes from a chimney or duct from within the shaft (though there is no duct visible from outside - there are structures now on terrace also so you can't tell, unless the ducts' length is such that their tops exceed the top of the terrace structures also). He said 'so what let them do'. I told him that this is not right for us because we stay in the vicinity and that these fumes are bothersome. Then he said that he doesn't know about that and that I can visit the 85C Flat to find that out. I told him that it may not be right to bother someone for this and also that I went up the top floor not expecting that there was a structure there now. I reminded him that this was, as per the signs, his flat. He said that he does not know about the duct.

And I reckon that they ('THEY' IS MCD AND STAKEHOLDERS AND GOVERNMENTS) have already taken a decision (clandestine or open) to make this entire stretch from Flats 83 to Flats 90 of Block C2B, Janak Puri, Delhi as Commercial and open up shops not only on the Ground Floor but also usurp the flats of the residents on the First Floor and the Second Floor and also convert the terrace (D) into a commercial entity. DELHI POLICE AND COURTS MUST STOP THIS. Every political party is perhaps involved in this. BJP is involved?, AAP is involved?, Congress (INC) is involved? HELLO DELHI POLICE AND DELHI DEVELOPMENT AUTHORITY AND THE INDIAN COURTS (JUDICIARY), THESE ARE DDA RESIDENTIAL FLATS. ARE YOU READING THIS? THESE FLATS WERE AND ARE MEANT FOR LIVING. FLATS ARE NOT MEANT TO BE CONVERTED INTO COMMERCIAL ENTITIES AND THUS CREATE A NUISANCE FOR OTHER RESIDENTS. Courts can, if they want, take suo motu cognizance and pull up the Governments for indulging in such a criminal act which is being accomplished 'step by step' by way of 'hoodwinking surreptitiously'. Courts should not think that this is a matter of governance and that this is not in their ambit. A Legal Eagle can throw better light on this.

Fire is burnt in DDA Flats. There is tandoor in DDA Flats. Coal is stored and burnt in DDA Flats. Commercial Kitchens run from DDA Flats. Upper Floor residents must object and stop this nonsense. One day there may be a blast in these fire wielding flats. Upper floors will also be affected.

Complaint submitted to Delhi Police at Janak Puri Police Station

Put MCD In Jail. They violate their own guidelines.

The Complaint draft had been more or less prepared by myself Monday, 30th May itself, but I thought that it needed some editing. On Sunday, 5th June at around 9:10 PM I reached the Janak Puri Police Station and submitted the Complaint and got the received copy. You see the Complaint in the image. The text of the Complaint is also copied pasted below.

MCD should be jailed. I told this to the person at the Police Station. I do not know if he is Ramesh Singh, the person who had spoken with me last Sunday. The person asks how come is it that there is a smell in my house when there are structures in between. He said also that my house is 60-70 feet away - that he has already done a recce (I doubt it), how can the smell be there. I told him that the problem is actually there, why would I complain to the Police? He says ok if the restaurants are found to be violating anything, then they will seal it. I told the person that I am informing them in advance that I will take this to the Delhi Government as well as the Central Government. And by the way, air is not like a solid that cannot flow. Air is air (gas) that can flow. I did not tell that. It is an obvious fact anyway.


Now in the Complaint I have mentioned about the distance being under 30 metres as the bird flies. I told this to the person. I told him also that as per my little knowledge the MCD itself has guidelines that no exhaust shall be within less than 250 feet from any house - though I am not sure whether it is 250 feet or 250 metres or something else but that there is something, in all probability, within the MCD's rules themselves.
I said that the MCD is violating its own rules then and therefore the MCD people should also be arrested. This is mentioned in the Plaint.

Dear Sir / Madam,

Reference: Smell from a Restaurant in DDA Residential Flats.
Please recall the telephone call from your Police Station on 29th May, 2016 at 4:18 PM after my call at 100 at 3:16 PM.

I stay in Block C2B of Janak Puri. From 24th May onwards there is a smell of rotten food and exhaust fumes in our Balcony and thence in our House. Smell intensity is variable. I did a little investigation of my own. This smell is because of the vapours or air that is expelled from the rear of a Restaurant that has started to operate from about 22nd May, 2016 from Flat No. 85A of the same Block C2B. The Restaurant is called 'Wah Ji Wah' and you can view their Board from the Main Road. The exhaust of this Restaurant is towards the staircase side of the flat. This staircase side or the side from where they are expelling fumes is in the "inside" of the Block. The fumes are expelled "inside" of the Block. The fumes are expelled in to an inner lane, and then from the inner lane they travel up to an inner road, and from that inner road these fumes travel up to our Flat. The horizontal distance in a straight line (as the bird flies) from this Flat to our Flat is less than 30 metres.

These vapours are a health hazard. This smell is an inconvenience and an infringement to our right to life with dignity. The Delhi Police must get this Restaurant closed. Our health is affected, our life is affected.

The Delhi Police may recall that in 2011-12 also the problem of vapours and smell had started from Flats nearby this particular Flat (in the same line) and I had written to you as well as the MCD. The problem has started again. If the MCD has allowed, then you should actually arrest the MCD people also. They did not take my consent when opening this Restaurant. I stay in close vicinity. There is some loose talk about restaurants being allowed in Roads of a particular width. That talk is bogus. Yes, it is bogus. "Provision" does not mean that "it must happen". "Provision' only implies 'a possibility' 'if and only if' 'nothing else' is being violated and then too only if the residents allow. The MCD did not take the residents into confidence before allowing this. They did not seek the residents' permission. They did not seek my permission. I have an objection. My objection is not necessarily to the fact that they did not seek my permission. When the Flats were purchased by the residents then there was no such rider that 'one day in the future illegal commercial activities will be allowed by the MCD here'. DDA (Delhi Development Authority) itself should object to the MCD's ways. Strange. I have an objection to this Restaurant. Get this Restaurant closed, that's it. It is a health hazard, it is an infringement on our simple lives, it is an inconvenience.

Burnt embers felt, smell intensity increased

Burnt Coal from Tandoor is going to be a health hazard

Smell intensity increased over the week in the meantime. It was off and on, off and on after that Sunday of 29th May. On Saturday, 4th June, it was more, and more or less continuous throughout the day. On Sunday 5th June too, it was more, and more or less continuous or constant or persisting through the day. I understood that yes now this is going to be a constant problem for us in the coming days, weeks, .. perhaps months.

I could now even smell burnt particles more. This could be coal - these could be particles from tandoor. The smell causes the formation of saliva immediately. It's pathetic. May these Sardars burn in hell for causing this misery to us. I can't help saying it. Yes, I mean it. They are causing problems for us. May they suffer the same way. May they burn in hell.

The whole night of 4th June actually, the smell and the burnt particles were in the air. On Sunday 5th June morning, I took a video film from my cell phone camera at around 4:50 AM. I came out from my house and went to this rear lane area and captured it after capturing the Block Road from Gate No. 2. It is a continuous shot. Let's see when I can uplolad that on this Blog. I discovered that another Restaurant's exhaust was on. It stays on for the entire duration of the night! This was told to me by the person who opened the shutter at the front of this same other outlet. I met him incidentally as I had gone to the front portion of this part of the Block around the same time of shooting. This is Bubble Tea Cafe where they also prepare pizzas. It is operating from C2B/86A, Janak Puri. Smell was emanating from here too, from the rear, and inside of the Block. So 2011-12 is being revisited. :-(

It has taken me a week to submit the Complaint. My health is not very good. Small small things take time. I'm grappling with myself. I'm grappling with my body balance all the time! Anyway, this Blog is not about the attack on my CNS (via the link mentioned just above). This is about the smell and toxic air particles which are both a nuisance and health hazard respectively.

As I am writing this on 5th night, 6th morning at 2:00 AM there is smell in my room! There is smell in my wardrobe. There is smell inside the Refrigerator. This is not a lie. This is not an exaggeration. This is the truth. I have mentioned that these Sardars should burn in hell. It is not just like that. There are burnt particles in my wardrobe, room, everywhere. There is smell in our Kitchen. It gets into nooks and corners and stays there for hours. When these Restaurants shut down (whenever that happens), it will take minimum 2 days for the smell to diminish considerably. And actually one can even 'smell these Restaurants' suddenly as you open a drawer even weeks afer the Restaurants close down and then you are reminded that yes there was a problem and its traces are still there! That is the severity of this nonsense. This is not exaggeration. I was told by whosoever that the last time when I had written a Complaint to the MCD (2011-12) these MCD idiots were going around telling themselves that I have exaggerated the problem in writing when it is not that severe! Can you believe that?


Ok, and what is the smell like?, what is the feel like? It is like (somewhat, and more) the smell or the feel when you stand near to  your neighbourhood local 'clothes' ironing' person with that 'coal iron' that he or they use to iron your clothes, and imagine that he has been ironing throughout the day when you have approached them and they have ironed many clothes. Ok? The feel and the smell is like when you stand near to the tandoor of a dhaba (roadside eatery). Ok? Them burnt embers - the smell and feel of them, get it?

These vapours and burnt embers can cause lung cancer, they can cause respiratory diseases, they can cause asthma, your bronchitis can be aggravated. You can begin to cough without realising or understanding what is actually causing these coughs. That is the nonsense that these bastard MCD people create. Haraamzaade.

Called The Police Control Room PCR at 100

Hope this is not beginning of a long ordeal. Hope this is settled quick, quick.
Smell is there of and on these days now. On 29th May (Sunday) it is more. Meraa dimaag kharaab ho gayaa phir se. Main kyaa karoon yaaron? Mujhe Samajh Nahin Aataa.

29th May 2016: Called 100 at 3:16 PM – told the person straightaway that this is not an emergency and that it is about smell problem that has started again. This smell is from a restaurant in the same line of residential flats that had restaurants in 2011-12. I told the person about the earlier problem of 2011-12 and that the SI Dharam Veer had said that they can shut down the Restaurants and then send the matter to Court. (For the earlier case refer http://www.sandeepvij.blogspot.com/p/health-hazard-toxic-fumes-obnoxious.html .) I told the Police Person that ok now this time they can send the matter to Court after shutting this Restaurant. Control Room person asked me about the attached Police Station. I told her Janak Puri. Then she asked Landmark. I told her Janak Puri Super Speciality Hospital. The Police person said that they will send PCR. I told the person that it is not an emergency and that they should see.
Then somebody else came on the line. I told him the problem in brief. He also said that they will send PCR. I told him that this is not an emergency. He still said that they will send PCR. I said ok.
No PCR came.
 

I got a call at 4:16 PM from 011 25551410. It was not noticed by chance. It went missed. I got a call again from this no. at 4:18 PM. When I responded the person conveyed his displeasure at not picking the phone (his call) after having called 100. I did not respond to that. I understood that this is from the Police Station. He asked my name. I told him. [“Kyaa naam hai aapkaa?” ..  “My name is Sandeep.”] Anyway I told him the problem in brief – ‘this time it is Wah Ji Wah, operating from Flat 85A, earlier it was Soya Express and Zaika in 2011-12, earlier problem stopped not because of my complaint but most probably their own business reasons’. He asked about the distance of this Restaurant from my house. I told him that in a straight line it is about 20 metres.
I mentioned Dharam Veer SI from 2011-12 and that he had mentioned about closing the Restaurants and then sending the matter to Court. The person said that they have to look at the present and not the past. He said that I should give a written complaint and then they will see what rights I have and what rights this Restaurant has. I said ok.

So now I have to write a Complaint. I really wish I was doing something better. But the rotten smell is there inside of our House as I was writing this on May 29, 2016 at 7:30 PM. It comes in in rushes along with the wind.

Smell of rotten food and from kitchen exhaust of restaurant inside our house

Another nonsense starts around me. Restaurant in residential locality. Date: May 24, 2016.

Once again smell of rotten food and from exhaust of a Restaurant Kitchen has started to come inside our house from our balcony. May 24, 2016, around evening I smelt rotten and non veg food in our Balcony. These are fumes from a Restaurant Kitchen. I went out to find out who the culprit is this time. And this time it is Flat 85A of Block C2B, Janak Puri where a Restaurant Chain 'Wah Ji Wah' has opened up an outlet. Yes, I had noticed a function 2-3 days before this outside of the Block here. They were inaugurating it. Their Kitchen faces the rear (inside of the Block). The exhaust fumes are expelled from the rear, inside into the Block. The fumes are expelled into a lane which provides access to the entry staircases of Flats 82-91 (ABC). There is also filth and muck in this lane or passage of our Block. I invite all to come and take a look. This part of the Block does not look like a residential locality where human beings stay. It looks very unkempt. It looks very dirty. It is bad. It is unhygienic.

Though the sign board visible from the main road says that they are a vegetarian outlet, I could smell non-veg too. I am not saying that they use human parts etc. in their preparations (I have no way to tell and I am also not suggesting that btw) but yes non-veg smell was there. It is not about veg smell or non-veg smell, but it is simply about toxic, harmful, inconvenient, menacing, obnoxious fumes from a "Commercial" "Kitchen" of a "Restaurant" operating from a "Residential" locality. And I could also smell 'rotten food' something. So now there is another bothersome stuff around me.

I do not know what prevents the Block C2B Residents Welfare Association from putting a complete full stop to this menace. Restaurants in residential localities are illegal. Any Clause that legitimises this presence is itself illegal. All residents of Delhi, albeit India, should note this and understand this. If any lawyer or person defends their illegal act by saying that the MCD or the Municipality has this provision, then I am telling you that you should not sit with one hand over the other. You should get those lawyers themselves into jail (this will not be easy). And of course the people who brought about such clauses ('ifs' and 'in those cases' etc.) in the first place should themselves be sent to jail (this will not be that difficult) because you see when our parents or whosoever got hold of these Flats from DDA then there was no such rider that these Flats will be converted into Restaurant Areas. So this 'conversion' is illegal. It is a simple, clear cut, gross violation of your 'rights to peaceful living', violation of your 'rights to a dignified living'. This is simply a Constitutional Violation itself. Even if the MCD 'now' allows restaurants in flats that face roads of more than a certain width, then it does not automatically mean that they can do what they feel like. Even in those cases, they are supposed to take the residents' consent "also". I repeat >> THEY ARE SUPPOSED TO TAKE THE RESIDENTS' CONSENT. In any case there is something wrong with the legislation itself and somebody must take it up.

So I am telling all that you should not recline and take things as they are happening. You have rights, and they are being violated. YOU HAVE RIGHTS AND THEY ARE BEING VIOLATED. All law abiding citizens must get together and prevent the MCD itself from illegalising Delhi. When the MCD comes to know of these ones 'officially', then instead of understanding the residents' plight and shutting the restaurant, what they do is challan the restaurant owner after confirming whether all formalities were completed or not! :-o I hope you understand. I mean they don't come to shut the place. They come to simply challan the place. And they are also offered meals later. You see between the MCD and the restaurants it is like this that 'yeh sab to chaltaa rahegaa (all this will continue to carry on)'. Their main aim is moolaah. .. 'Illegal Restaurant? .. To hell. What illegal? We don't understand that one. Let's just check whether clearances were taken.' And their clearances are some administrative stuff. One of them is called HTL (Health Trade License). And Health Trade License is provided with no actual ground research or fact finding. It's a mere eye wash. Those clearances can be obtained in this way or that way. Those clearances do not take into account the residents nearby. And your complaint is also not accorded value. The resident is then told about the restaurant in residential area "provision". These chaps causing this inconvenience, problem from C2B/85A, Janak Puri are Sardars. One of the earlier trouble makers, 'Soya Express', were also Sardars. Soya Express and Zaika actually had the chimney exhaust inside of the DDA Flats shafts, and that is completely illegal. MCD knew about it. MCD did nothing. If I recall I had written to DDA also about this. Soya Express and Zaika went away after a few months not because I had written to the MCD and the Police but because their business did not do that well here. I know that. I mean I am not singing my own praises. But then now we have another problem in this Wah Ji Wah. I don't think they have an exhaust chimney in the sacrosanct DDA Flat shaft, but they are expelling fumes inside of the Block, and they travel into our Balcony and into our House. Our Balcony faces an internal Block street or lane into which these fumes arrive from another inner lane or passage into which these exhaust fumes are expelled. That is illegal (Expelling fumes inside of a residential area from a Commercial Kitchen {of a Restaurant} is illegal). I do not know if the Block C2B Residents Welfare Association people have any stakes! The earlier RWA President (Russian connection?) had a stake. I am 100% sure of this. He used to defend Soya Express defiantly. He used to shout! He used to lie straightaway that there is no smell!
